Trump has long used the "Peekaboo" nickname for James, the first Black woman elected to statewide office in New York, for years without explaining it. Both sides have now appealed to New York's highest court. Trump's Justice Department then went after James. A grand jury indicted her on mortgage fraud charges in October 2025, after Trump installed his former personal lawyer, Lindsey Halligan, as the federal prosecutor. A judge dismissed the case the next month, ruling that Halligan was unlawfully appointed. Two grand juries then refused to indict James again. The DOJ is currently appealing the dismissal.
